2. Which state or territory do I need to obtain a Grant
You will always apply in the State or Territory where the deceased held assets.
3. What if I am not in the place where I need my Grant
It does not matter where you are located, we can still obtain a Grant for you.

6. When is a Grant of Probate Required
A Grant of Probate is required in Australia if:
- Accommodation Bond is held by a Retirement Home.
- There is property (houses, buildings or land) owned by the deceased and there are other assets held by the deceased which require a Grant of Probate.
- A bank or other financial institution with which the deceased held assets. This is normally if the amount in the account is over the specific threshold set by that institution*.
*Banks and other financial institutions set their own limit above which Grant of Probate will be required, so it’s worth checking with the individual organisation as to whether they require Probate.

8. What is a Grant of Probate
Probate is the word normally used to describe the legal and financial processes involved in dealing with the property, money and possessions (called the assets) of a person who has died. Before the spouse, next of kin or where there is a will, the executor can claim, transfer, sell or distribute any of the deceased’s assets they may have to apply for Grant of Probate. When the Grant of Probate has been granted through either a Grant of Probate through the Supreme Court the executor can start to deal with the deceased person’s assets in accordance with the will. If the deceased died without a will the law will determine who should receive everything.
9. What is a Grant of Letters of Administration
Letters of Administration is the phrase used to describe the legal process involved in obtaining a Grant of Letters of administration from the Courts, which allows the administrator(s) to manage and distribute the deceased’s assets. There are two distinct types of applications for a Grant of Letters of Administration:
- Letters of Administration (Intestacy) the deceased died without leaving a will (died intestate).
- Letters of Administration (with the Will annexed) the deceased left a
Will but there is no executor available to apply for a Grant of Probate. For example, if the will did not name an executor, or the sole executor has died or is otherwise unwilling or unable to act.
